Agreement to these terms

These Terms of Use (“Terms”) are an agreement between you and M87 LLC (“M87 LLC,” “we,” “us,” or “our”) governing your access to and use of Poopy, including the Poopy mobile application, poopyapp.com, related websites, software, features, content, and services that link to these Terms.

By accessing or using Poopy, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Poopy.

Eligibility

You must be legally permitted to enter into these Terms in the jurisdiction where you live.

Poopy is not intended for children under 13. If you are under the age at which you may independently agree to online services in your jurisdiction, you may use Poopy only with the involvement and permission of a parent or legal guardian where permitted by law.

What Poopy provides

Poopy is designed to help dog owners record, organize, review, and share observations related to their dog’s digestive history.

Depending on the features available to you, Poopy may allow you to:

• record bowel movements and related observations;
• upload or capture stool photos;
• record consistency, color, appearance, symptoms, food changes, medications, supplements, and other context;
• receive automated or structured visual observations;
• correct or supplement saved information;
• view patterns based on your dog’s own recorded history;
• organize digestive changes or related events over time;
• create reports or summaries from saved history; and
• export or share information at your direction.

Features may change, be added, be removed, or remain unavailable while Poopy is being developed.

Veterinary and medical disclaimer

Information available through Poopy is provided for informational, organizational, and recordkeeping purposes.

Stool appearance, photos, patterns, timing, symptoms, automated observations, historical comparisons, and other information may provide useful context, but they cannot by themselves establish a diagnosis or determine the cause of a medical problem.

You are responsible for deciding when to seek veterinary care. If you are concerned about your dog’s health, contact a veterinarian.

Do not delay or disregard professional veterinary advice because of something displayed, generated, summarized, or omitted by Poopy.

For urgent symptoms, suspected poisoning, foreign-object ingestion, severe pain, significant bleeding, repeated vomiting or diarrhea, difficulty breathing, collapse, or another possible emergency, contact a veterinarian or emergency veterinary service promptly.

Automated and AI-assisted processing

Some Poopy features may use automated systems, including artificial intelligence or machine-learning systems, to analyze photos or other information and convert them into structured observations.

Automated outputs are estimates or observations based on the information available to the system. They may be incomplete, inaccurate, or affected by image quality, lighting, angle, obstruction, missing context, technical limitations, or other factors.

Automated output is not veterinary judgment.

Where correction features are available, you are responsible for reviewing information that matters to you and correcting observations that you believe are inaccurate.

Personal Pattern

Personal Pattern is designed to describe patterns in qualifying observations from your dog’s own recorded history.

It is not a population-wide normal range, veterinary assessment, health score, diagnosis, prediction of disease, or guarantee that a particular observation is medically normal.

Personal Pattern may require a minimum amount of qualifying history before it becomes available. Missing observations, inconsistent logging, corrections, and new information may change what Poopy can reasonably display about your dog’s recorded pattern.

A result that appears consistent with your dog’s prior recorded history does not establish that your dog is healthy. Likewise, an observation that differs from prior history does not establish that something is medically wrong.

Vet Reports

Poopy may allow you to create reports, summaries, or exports intended to make saved history easier to review or share with a veterinary professional.

Vet Reports reflect the information available to Poopy at the time the report is created. That information may include owner-entered observations, automated observations, corrections, photos, symptoms, timing, context, Personal Pattern information, and other saved history.

A Vet Report is not a medical record created by a veterinarian, and it does not establish a diagnosis, prognosis, treatment plan, or cause.

Unrecorded periods do not prove that no bowel movement, symptom, food change, medication, or other event occurred during those periods.

You are responsible for deciding whether and with whom to share a report.

Accounts

Some features may require an account.

You agree to provide accurate information where required, maintain the security of your account credentials, and promptly notify us if you believe your account has been accessed or used without authorization.

You are responsible for activity conducted through your account unless applicable law provides otherwise.

You may not sell, transfer, share, or provide access to your account in a manner that violates these Terms or compromises the security of Poopy.

Your content

“User Content” means information, photos, notes, profile information, observations, feedback, and other material you submit to or create through Poopy.

As between you and M87 LLC, you retain ownership of rights you may have in your User Content.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify as technically necessary, transmit, display, and otherwise use your User Content for the limited purposes of operating, maintaining, securing, supporting, and improving Poopy and providing features you request.

This license continues for as long as reasonably necessary to provide the service and handle retained copies, backups, security records, or other information we are permitted or required to retain.

You represent that you have the rights necessary to provide User Content to Poopy and permit us to process it as described in these Terms and our Privacy Policy.

Feedback

If you voluntarily provide suggestions, ideas, feature requests, or other feedback about Poopy, you agree that we may use that feedback without restriction or compensation to you.

Acceptable use

You may not use Poopy to:

• violate applicable law or the rights of another person;
• upload material you do not have the right to use;
• distribute malware, malicious code, or harmful content;
• attempt to gain unauthorized access to accounts, systems, infrastructure, or data;
• interfere with the operation, security, or availability of Poopy;
• scrape, harvest, or systematically extract information except as expressly permitted;
• reverse engineer or attempt to discover source code except where applicable law expressly permits it;
• circumvent technical restrictions or security measures;
• impersonate another person or misrepresent your affiliation with another person or organization; or
• use Poopy in a manner that is fraudulent, abusive, harmful, or inconsistent with its intended purpose.

We may investigate suspected violations and take reasonable action to protect Poopy, our users, or others.

Purchases and subscriptions

Poopy may offer paid features, subscriptions, trials, or other purchases.

When a purchase is made through an app marketplace such as the Apple App Store, billing, renewal, cancellation, refunds, and certain other transaction terms may be governed by that marketplace and your agreement with it.

Unless otherwise stated at the time of purchase, subscriptions may automatically renew until canceled in accordance with the purchase terms presented to you.

Prices and available plans may change. Changes will apply prospectively and subject to any notice required by applicable law or marketplace rules.

If Poopy does not currently offer paid features, this section will apply if and when those features become available.

Third-party services

Poopy may rely on or interact with third-party services, including hosting providers, authentication services, app marketplaces, payment providers, automated-processing providers, analytics services, communications systems, or other infrastructure.

We do not control third-party services and are not responsible for their independent acts, content, availability, terms, or privacy practices.

Your use of a third-party service may be governed by separate terms between you and that provider.

Apple App Store

If you download Poopy through the Apple App Store, you acknowledge that these Terms are between you and M87 LLC, not Apple, and that Apple is not responsible for providing or supporting Poopy except as required under its applicable marketplace terms.

Intellectual property

Poopy, including its software, designs, interfaces, text, graphics, branding, logos, features, underlying systems, and other materials provided by us, is owned by or licensed to M87 LLC and is protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Poopy for its intended purposes.

These Terms do not transfer ownership of Poopy or our intellectual property to you.

Service availability and changes

Poopy is an evolving product. Features, interfaces, models, calculations, eligibility requirements, reports, storage methods, and other parts of the service may change over time.

We may modify, suspend, limit, discontinue, or replace all or part of Poopy at any time, subject to applicable law.

We do not guarantee uninterrupted availability, permanent storage, compatibility with every device, or continued availability of any specific feature.

You should keep separate copies of information that you consider especially important.

Disclaimers

To the maximum extent permitted by applicable law, Poopy is provided on an “as is” and “as available” basis.

We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and any warranties arising from course of dealing or usage of trade, to the extent those warranties may legally be disclaimed.

We do not warrant that:

• Poopy will always be available or error-free;
• automated observations will always be correct;
• photos or other information will always be processed successfully;
• Personal Pattern will identify every meaningful change;
• any particular observation is healthy, unhealthy, significant, or insignificant;
• a Vet Report contains every fact relevant to a veterinary assessment; or
• information shown by Poopy will prevent illness, injury, loss, or another adverse outcome.

Some jurisdictions do not allow certain warranty disclaimers, so some of these provisions may not apply to you.

Limitation of liability

To the maximum extent permitted by law, M87 LLC and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of or inability to use Poopy.

To the maximum extent permitted by law, we are not responsible for losses arising from reliance on automated observations, historical comparisons, Personal Pattern, Vet Reports, missing information, user-entered information, or a decision to seek, delay, or decline veterinary care.

To the extent applicable law permits a monetary limitation, our aggregate liability for claims arising out of or relating to Poopy or these Terms will not exceed the greater of the amount you paid us for Poopy during the twelve months before the event giving rise to the claim or US $100.

These limitations apply only to the extent permitted by applicable law. Nothing in these Terms excludes liability that cannot legally be excluded or limited.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless M87 LLC and its affiliates, officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your violation of these Terms, your unlawful use of Poopy, or your infringement of another person’s rights.

This section does not require you to indemnify us for conduct for which indemnification cannot legally be required.

Suspension and termination

You may stop using Poopy at any time.

We may suspend or terminate access to Poopy if we reasonably believe you have materially violated these Terms, created a security risk, used Poopy unlawfully, harmed the service or other users, or where suspension or termination is otherwise reasonably necessary to operate or protect the service.

We may also discontinue Poopy or particular features generally.

Provisions that by their nature should survive termination, including provisions concerning ownership, disclaimers, limitations of liability, indemnification, disputes, and other accrued rights, will survive.

Governing law and disputes

These Terms are governed by the laws applicable to M87 LLC in the United States, without giving effect to conflict-of-law principles that would require application of another jurisdiction’s laws, except where applicable consumer law requires otherwise.

Before beginning formal legal proceedings, you and M87 LLC agree to make a reasonable effort to resolve a dispute informally by contacting the other party and describing the issue.

Changes to these Terms

We may update these Terms as Poopy evolves, our business changes, or legal requirements change.

When we update the Terms, we will revise the “Last updated” date above.

If a change is material, we may provide additional notice through Poopy, our website, email, or another appropriate method.

Your continued use of Poopy after updated Terms become effective constitutes acceptance of the updated Terms where permitted by law.

General terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, financing, or other business transaction.

These Terms, together with policies and terms expressly incorporated by reference, constitute the agreement between you and us regarding your use of Poopy.
